Below are policies as required by law

COVID POLICY

Daybreak Fitness is committed to your health and wellbeing, and take seriously the need to ensure clients are able to access our services safely. The outbreak of COVID-19 has highlighted the importance of health and safety precautions in outdoor training, and the following measures have been implemented accordingly.

 

Each client is provided with training mats which mark your personal space, which are placed 2 metres apart to adhere to social distancing requirements. The use of a towel is recommended. Equipment and mats are cleaned before each use.

 

Clients and trainers are encouraged to wash their hands before and after training, as well as use the hand sanitiser available at each session. We also provide training gloves, which are an excellent way to prevent the spread of disease.

 

Current requirements for outdoor training are regularly monitored and we adjust session sizes according to NSW Health requirements. Attendance for each session is recorded and clients will be notified immediately if a close-contact has been made. Members are required to provide proof of vaccination prior to training as recommended by NSW Health, and trainers are required by Daybreak Fitness to be fully vaccinated.

 

We recommend that our members do not attend training if they are feeling unwell or if they have been advised to self-isolate by NSW Health, and request that our members notify trainers if they have been in contact with someone who has tested positive for COVID-19.

PRIVACY POLICY

Scope Of Policy

Daybreak Fitness is committed to protecting your privacy and any personal information provided to us. Daybreak Fitness complies with the Privacy Act 1988 (Cth). This policy explains how we may collect, use, disclose and otherwise handle personal and sensitive information.

Daybreak Fitness is committed to safeguarding personal privacy. We recognise that individuals have the right to control how their personal information is collected and used. Unless given consent to do otherwise, Daybreak Fitness will only collect and use personal information as detailed below.

For the purposes of this Privacy Policy personal information may mean some or all of the following: a client’s name, contact details, date of birth, emergency contact details, bank account and/or credit card details, payment history and sensitive information.

Collecting Personal Information

​

Daybreak Fitness will not collect or monitor any personal information about an individual without their consent.  The only personal information collected is what is provided voluntarily by a client or prospective client.

We collect personal information primarily to enable us to provide clients with our services or functions related thereto. Daybreak Fitness may also use the information for marketing to you or for any other purpose permitted under the Privacy Act 1988 (Cth).

You don’t need to identify yourself when you deal with us ( e.g. to find out more about packages) however in certain situations we will only deal with individuals who have identified themselves to us.

When a package is purchased personal information will be requested in order to provide the requested service or product, provide updated information, and advise of other Daybreak Fitness products, which may be of interest. You are not obligated to provide personal information however failure to do so may result in Daybreak Fitness being unable to provide services or products to you.

Personal information is collected directly from clients or potential clients when they personally complete and submit an application to Daybreak Fitness. This can be done in person at one of our outdoor locations, online via our website or on the phone.

Collecting Sensitive Information

For the purposes of this Privacy Policy sensitive information means the information a client has disclosed to us about their physical and mental health and wellbeing.

Sensitive information will only ever be used for providing services to clients. Such information will not be used or disclosed for any other purposes without consent, except in exceptional cases when disclosure may be required by law or is necessary to protect the rights or property of Daybreak Fitness, or any member of the public, or to lessen a serious threat to a person's health or safety. For the purposes of this Privacy Policy sensitive information is a subset of personal information.

Using And Disclosing Your Personal Information

Personal Information will be used for the following primary purpose:

  • To fulfill obligations under a client's chosen package and/or any other contract between him/her and Daybreak Fitness;

  • To render services under a client’s chosen package;

  • To provide information about products, service and/or special offers to clients;

  • To obtain opinions or comments about products and/or services from clients;

  • To record statistical data for marketing analysis from clients;

  • To promote and market all current and future Daybreak Fitness businesses, products and services;

  • To assist with Daybreak Fitness’s internal business processes;

  • To conduct market research and/or to improve Daybreak Fitness’s products and service offerings:

  • For any other purposes that could be reasonably expected of Daybreak Fitness; and

  • To enable Daybreak Fitness to comply with its obligations under law.

Daybreak Fitness may employ other companies or service providers to assist us in providing our services or any functions related to our services, including (but not limited to) marketing, market research, mail-house services, hosting and product development services, analysis of client lists and/ or consulting services. Daybreak Fitness may disclose, and these third parties may have access, to the personal information that is needed to perform their specific function. They cannot use that information for other purposes.

The third parties to which Daybreak Fitness may disclose personal information to includes:

  • related entities of Daybreak Fitness;

  • contractors and suppliers Daybreak Fitness engages to provide products and/or perform services;

  • commercial partners with whom Daybreak Fitness has agreed information sharing arrangements with;

  • Daybreak Fitness’s professional advisors such as legal professionals and accountants;

  • law enforcement bodies;

  • a purchaser of all or part of Daybreak Fitness’s business; and

  • any other person for any other purposes that would be reasonably expected (including if required by law).

Daybreak Fitness recognise the trust with which individuals provide personal information, and such information will not be used or disclosed for any other purposes without consent, except in exceptional cases when disclosure may be required by law or is necessary to protect the rights or property of Daybreak Fitness, or any member of the public, or to lessen a serious threat to a person's health or safety.

Photographs

We may take photographs of you attending our sessions and we may wish to use them for marketing and advertising purposes. Unless you advise us otherwise, you expressly agree and consent to the use of any photographs, which may include you, for the aforementioned purposes, without compensation.

Contact By Daybreak Fitness

​

Daybreak Fitness does not send advertising information without obtaining prior consent. If an individual receives communications from Daybreak Fitness which they do not wish to receive, they may remove their name from the database by contacting us.

Individual's Right Of Access

​

Individuals have the right to review, amend or delete personal and/or sensitive Information that may be recorded on the Daybreak Fitness database.

A request may be made to delete personal and/or sensitive information, and all reasonable steps to delete the information will be made, except where it is required for legal reasons. Deletion of information may result in Daybreak Fitness being unable to provide certain products or services.

Storage And Security Of Personal And/Or Sensitive Information

Daybreak Fitness takes all reasonable steps to keep secure personal information recorded and to keep this information accurate and up to date. Daybreak Fitness only permits authorised personnel to access your information and information will only be disclosed to third parties where they have the appropriate authority.

Daybreak Fitness And Links To Other Websites

​

Daybreak Fitness provides links to websites outside of the Daybreak Fitness site. These linked sites are not under the control of Daybreak Fitness, and Daybreak Fitness is not responsible for the conduct of companies linked to the Daybreak Fitness website, nor for the performance or otherwise of any content and/or software contained in such external websites.
